The Administrator has issued this Data Processing Policy in compliance with the information obligation arising from Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (OJ EU L2016, No. 119, p.1) [hereinafter referred to as GDPR].
Purposes of Processing Personal Data and Legal Basis for Data Processing
Processing of Your Personal Data is Carried Out:
For the purpose of: conducting promotional and marketing activities by the Administrator electronically, involving informing about the Administrator and its activities and encouraging the conclusion of an agreement with the Administrator, particularly using the email address provided by you for this purpose and via the Newsletter which you can subscribe to through the website https://BLUEAMBER.pl (hereinafter referred to as the site, website, or BLUEAMBER site), based on: Article 6(1)(a) GDPR;
For the purpose of: performing agreements concluded with you or taking actions (at your request) before concluding such agreements, based on: Article 6(1)(b) GDPR;
For the purpose of: performing agreements with an entity of which you are a representative in contacts with the Administrator or taking actions before concluding such agreements, based on: Article 6(1)(f) GDPR;
For the purpose of: conducting promotional and marketing activities by the Administrator by means other than electronic, in particular: informing about the Administrator and its activities, responding to questions asked, based on: Article 6(1)(f) GDPR;
For the purpose of: conducting statistical measurements concerning: the Site, users of the Site and their preferences; monitoring traffic on the Site; distinguishing users of the BLUEAMBER Site (without identifying them); ensuring the security and functionality of the website (including detecting instances of malfunction); continuously improving and adapting it to user preferences, based on: Article 6(1)(a) GDPR;
For the purpose of: running a fan page on the Facebook platform, as well as accounts on Instagram, LinkedIn, and TikTok (hereinafter referred to as accounts), communicating with followers of the Accounts, based on: Article 6(1)(a) GDPR;
For the purpose of: recruiting for work or cooperation with the Administrator, based on: Article 6(1)(a) GDPR;
For the purpose of: establishing, pursuing, and defending against claims, based on: Article 6(1)(f) GDPR.
Legitimate Interest
The legitimate interest for processing your personal data on the part of the Administrator or third parties is:
- In relation to the case in point 2(c) above — the ability to communicate with the entity interested in entering into an agreement with the Administrator and fulfilling the agreement concluded with them;
- In relation to the case in point 2(d) above — the Administrator’s marketing and promotional activities;
- In relation to the case in point 2(h) above — establishing, pursuing, and defending against claims.
Recipients of Personal Data / Categories of Data Recipients
Your personal data will be transferred to:
- Entities authorized by law to the extent necessary to fulfill the Administrator’s obligation to transfer data,
- Entities authorized based on agreements concluded by the Administrator to the extent necessary to fulfill the mentioned agreements, particularly: i) notaries, real estate advisors, ii) entities providing financial and accounting services, iii) banks and financial institutions, iv) entities providing services related to ensuring access and maintaining the Administrator’s email or managing the website or Accounts, as well as to you.
Transfer of Personal Data to a Third Country or International Organization
The Administrator does not intend to transfer your personal data to a third country or an international organization.
Data Retention Period / Criteria for Determining the Period
Your personal data processed based on consent will be stored for the duration of its validity, i.e., until it is withdrawn, and after that for the period necessary for the Administrator to fulfill the obligations imposed on the Administrator by generally applicable laws.
Your personal data stored on bases other than consent will be kept for the duration of the cooperation accordingly: with you or the Entity you represent, and after its termination for the limitation period of claims related to this cooperation or the period necessary for the Administrator to fulfill the obligations imposed on the Administrator by generally applicable laws.
Rights
The detailed scope of your rights as a data subject is contained in Chapter III of the GDPR entitled „Rights of the data subject.” At any time, you are entitled to exercise these rights, under the terms provided by the applicable regulations, in particular:
- Request access to your personal data,
- Request correction of your personal data,
- Request deletion of your personal data, except in situations where processing is necessary:
i) to comply with a legal obligation that requires processing under Union or Member State law to which the Administrator is subject, or to perform a task carried out in the public interest or in the exercise of official authority vested in the Administrator,
ii) for archival purposes in the public interest, scientific or historical research purposes, or statistical purposes, where the deletion is likely to render impossible or seriously impair the achievement of the objectives of that processing,
iii) for establishing, pursuing, or defending claims, requesting restriction of the processing of your personal data, objecting to the processing of your personal data based on Article 6(1)(f) GDPR, requesting the portability of your personal data, based on Article 6(1)(a) GDPR or Article 6(1)(b) GDPR, provided the processing is carried out by automated means, lodging a complaint with the Supervisory Authority (in Poland, this is the President of the Personal Data Protection Office, formerly the General Inspector for Personal Data Protection) to the extent that the processing is based on your consent – you are entitled to withdraw your consent to processing at any time without affecting the lawfulness of the processing carried out based on consent before its withdrawal.
Information on the Requirement/Conditions for Providing Personal Data and the Source of Data
Providing your personal data is not a statutory requirement. However, failure to provide data will hinder or even make it impossible, as appropriate: to contact you, to conclude or perform an agreement, or to communicate via the Site or Accounts.
If the data was not provided directly by you, it was obtained by the Administrator from a Site user who claimed to act on your behalf or from publicly available sources. In such cases, the Administrator processes data to the extent of your contact details or as necessary to conclude or perform an agreement (so-called categories of relevant personal data).
Automated Decision-Making
Your personal data may be processed in an automated or partially automated manner. However, your personal data will not be used to make decisions based solely on automated processing (including profiling) that produce legal effects concerning you or similarly significantly affect you.
